Weekly update to the Sperry's Beach situation: as of August 24- At a Public Meeting held Sunday August 21, 7:00 pm at the Petite Riviere Fire Hall Committee members reported on the August 17 meeting with DNR Minister Richard Hurlburt, Deputy Minister Peter Underwood, MLA Kerry Morash and Senior Solicitor Diane Rowe; and the August 19 meeting with Municipality of the District of Lunenburg Recreation Focus Group Chair Councillor Don Zwicker, Deputy Warden Elmer Garber, and Recreation Director Carroll Randall The Committee received unanimous endorsement to undertake the following: 1) immediately open a dialogue with the Confederacy of Mainland Mi'Kmaq, the Mi'Kmaq Burial Ground Research and Restoration Association, and the Nova Scotia Museum with the intent of achieving Provincial and Federal recognition and protection for the Heritage interest area (ref 1604 map "Port de La Heve", Samuel Champlain) including, but not limited to, the Indian Hill, Indian Hill Pond(s) and historic burial grounds adjacent to Sperry's Beach 2) immediately instruct Stewart McKelvey Stirling Scales, under the direction of Senator Jim Cowan, to identify the most appropriate and effective instrument for holding the Government of Nova Scotia accountable for upholding the Statutes and Regulations of the Province of Nova Scotia, and to commence preparation of possible Court action against the Government of Nova Scotia should the Government fail, in a timely manner, to provide either a) substantive documented proof of ownership claimed by the estate of Lawrence Himmelman of lands between the Ordinary Mean Highwater Mark and those Crown lands referenced at Orders in Council 95-737 and 96-899, and the infilled tidal salt marsh as identified on DNR Field Plot P-110/95 or b) - confirmation of Crown ownership of all lands referenced at a); - an order causing the supervised removal of the outer barbed wire fence; - an order causing the infilled tidal salt marsh, as identified on DNR Field Plot P-110/95, to be fenced off to prevent its further use for private profit as leased pasture land, and to prevent its further befouling with excrement; and - an order causing the Heritage interest area identified at 1) to be fenced off to comply with Sections 7(1), 8(1-2), 9 and 11 of the Cemeteries Protection Act to prevent further desecration, and to avoid any further potential damage prior to protection as noted at 1) Post Removal Not a word from MLA Morash re (Minister of Natural Resources) Richard Hurlburt's lack of response to Mr Morash's June 27 and July 14 letters re the removal of the three fence posts on Crown land http://www.chebucto.ns.ca/~tom_d/sperry/img/post.jpg Gate / Padlock Not a word from MLA Morash re David Himmelman's lack of response to Mr Morash's June 27 letter re: unlocking the gate pending resolution http://www.chebucto.ns.ca/~tom_d/sperry/img/lock.jpg Burial Grounds cattle continue to roam freely through the burial grounds http://users.eastlink.ca/~td/ -- No virus found in this outgoing message.
