NOTICE OF CONSULTATION

The following document, namely the Compliance and Enforcement Policy for
the Habitat Protection and Pollution Prevention Provisions of the Fisheries
Act, is being placed on the Green Lane for a period of consultation and
public comment that will last 60 days. This period will run from August 30,
2001 to October 30, 2001.

Any interested person—whether an individual, private company, federal
department or agency, provincial, territorial or aboriginal government,
environmental, health or labour group, aboriginal group or municipality—may
comment. Environment Canada invites all interested persons to provide their

        HEADLINE: Comment sought on Fisheries Act enforcement policy
                  document

     ** Environment Canada (DOE) has released for comment a compliance and
        enforcement policy document relating to the pollution prevention
        and habitat protection provisions of the federal Fisheries Act.
        These include sections 20-22, 26-28, 30, 32 and 34-42.

        The document was drafted jointly by DOE and the Department of
        Fisheries and Oceans (FDO), as the two departments share
        responsibilities for administering and enforcing the pollution
        prevention provisions of the Act. It outlines the role of
        regulatory officials in promoting, monitoring and enforcing the
        P2/habitat protection provisions of the Act. As a national policy,
        it applies to all those with regulatory authority, from Ministers
        to enforcement officers.

        The policy document also explains the means available to the
        authorities to promote and ensure compliance with the provisions.
        Some of these include reviews of proposals (in preparation for
        authorization), dissemination of education/information materials,
        along with technology transfer initiatives, consultation on
        regulatory development and amendment, and the issuing of
        guidelines/codes of practice.

        The full range of responses to alleged violations is set out as
        well, including the circumstances under which they will be
        exercised. In doing so, it helps clarify what is expected of all
        who have responsibility for pollution prevention and habitat
        protection, including governments, industry and individuals. The
        policy includes a statement of commitment to fair, consistent and
        predictable enforcement.
