Dear Johns & All,
     Whereas both Johns are intelligent and rational, I assume you are=20
pulling my leg but, for the benefit of those who suppose you are=20
serious, I will undertake a back of envelope  risk analysis.
     And to put this in context I remind you of the irate adult who fumed=

"Do you know how many times that rabbit of yours would have died if I=20
hadn't taken care of it ? And his child says "Once ?" Probability is=20
tricky.

1)    About 1% of woodland in NS is cut annually and, allowing for down=20
time and adverse weather, over roughly 10 months/year; 0.1% per month >>=20
0.25%  over the sensitive period May 1- July 15.
     So the chance of a given nest being in an area cut during the=20
sensitive period ia about 1 in 400.
2)     Assuming two breeding years, starting in the 2nd year, four eggs=20
per year, no second nest if the first is destroyed and steady state=20
population only 2 can survive to the start of the 4th year; counting the=20
initial adults 8 of 10 must die. That is 80% or 320 in 400.
3)     Thus the overall risk experienced by these birds is about 320=20
times as great as the risk experienced due to forestry operations.
4)    Remember also that, other matters being equal, a death early on=20
increases the survival rate of the remainder.
5)    Those who wish to prove how easily this imaginary risk could be=20
reduced to zero, by not cutting during the sensitive period, might=20
consider borrowing several million, buying some woodland, keeping=20
careful records and seeing how that turns out.
6) Alternatively one could turn the clock back 100 years, give or take a=20
few, and undertake predator reduction; Crows, Jays, Hawks....

my home village of Carleton, in Yarmouth County, I witnessed what I believ=
e to be the destruction of a Common Nighthawk nest by a forestry operation. =
I believe this because I was listening to a tree harvesting machine, block=
ed from my view from a stand of softwood, but very loud as I was only a cou=
ple hundred of meters away. All of a sudden, at about 2 PM, a Common Nighth=
awk flew up from where the machine was harvesting and subsequently circled=
 the machine a couple of times before disappearing.<o:p xmlns:o=3D"#unknown"=
></o:p></span></p><p class=3D"MsoNormal"><span style=3D"font-size:10.0pt;fo=

 Department of Natural Resources. The regional biologist was not in but abou=
t an hour later a wildlife technician called to tell me not to worry. The b=
iologist had indicated that Common Nighthawks don=E2=80=99t nest in the for=
est and have a wide foraging area so it was just passing by. I disputed thi=
s claim, noted that forestry should not be permitted during the bird breedi=
ng season, and asked that at minimum, the Department inform the landowner t=
hat an endangered species, listed under the Species at Risk Act, was likely =
nesting in the area of forestry operations. =C2=A0I was then informed ther=
e was nothing the government would do because the forestry operation was on =
private land.<o:p xmlns:o=3D"#unknown"></o:p></span></p><p class=3D"MsoNor=

isk legislation, it is ok to destroy the nest, eggs, or young of an endange=
red migratory bird if it is on private property. I wonder if they are plann=
ing on allowing the hunting of fawns and moose calves on private property y=
