Quoting John Kearney RE: Nova Scotia Sunday Hunting survey

"While we are having this discussion on hunting and conflicting land =
use, I
would like to take the opportunity to raise once again the question of
trespassing in Nova Scotia.
I have carefully read several times the relevant trespassing act of the
province and it is my interpretation of the last few sections of the act
that neither hunters or birdwatchers are trespassing or restrained in
carrying out their pastime in any forested area, even when no =
trespassing
signs or no hunting signs are posted. Is there someone on this list who =
is
qualified to give a legal opinion about this?"

Pasted below is the section of the Protection of Property Act that I =
believe John was referring to. I would like clarification as well.

15(2) No person may be prosecuted for contravening any notice given =
pursuant to this Act prohibiting entry or prohibiting activity on forest =
land if that person is hunting as defined in the Wildlife Act, fishing, =
picnicking, camping, hiking, skiing or engaged in another recreational =
activity or engaged in a study of flora or fauna. R.S., c. 363, s. 15.

To me it raises more questions than it answers. What is meant by notice =
given pursuant to the act? What about lands where no notice is given? =
Are private roads or old tote roads through woodland included as part of =
forest land? (according to the definition of forest land given in the =
Wildlife Act I don't believe so) Some folks would consider ripping =
through the forest on an ATC to be a "recreational activity". Surely =
that would not be included in the exemption to prosecution. In any case =
operators (and all trespassers) would still liable for damages.
